Title

Issue relating to IPR with Special reference to Media and Cyber Space

Abstract

The evolution of technology and the expansion of digital platforms have profoundly impacted the field of intellectual property rights (IPR), especially in relation to media and cyberspace. The rise of the internet, social media, artificial intelligence, and digital content-sharing platforms has led to new and complex forms of infringement, often challenging the scope and enforcement of traditional IPR frameworks. This dissertation explores the multifaceted issues emerging at the intersection of intellectual property, media, and cyber law, with a specific emphasis on the Indian legal system. Adopting a doctrinal research methodology, the study examines the historical development of IPR, the current legal structures governing it, and the emerging challenges posed by digital environments. Key areas of concern include copyright infringement, online piracy, trademark dilution, and the unauthorized use of content and identity in digital spaces. The analysis extends to the gaps in legislative coverage and enforcement mechanisms, particularly in relation to cyber violations that transcend national boundaries. The research highlights the urgent need for legal reform to address the inadequacies of existing statutes in regulating digital IPR violations. It proposes legislative updates, greater regulatory clarity, and the incorporation of technological safeguards to ensure effective protection of intellectual property in cyberspace. By addressing these critical issues, the dissertation contributes to the ongoing legal and policy discourse surrounding the protection of intellectual assets in an increasingly interconnected and media-driven world.
