In every marriage, both spouses contribute equally to the accumulation of assets and the smooth functioning of the household. The term "spousal property” or “marital Property” s includes all proprietary rights held by both spouses, as well as custody and welfare responsibilities for the children, which are financed using their combined earnings after marriage or through gifts received jointly during their marriage. In India, there are several laws made to safeguard property rights of the spouses and ensure proper management and transfer of property. But there is no specific law or code for the validity of prenuptial agreements specifically for the protection of property. This article focuses on the need for prenuptial agreement to safeguard property rights and the validity to which extent these agreements can be applied in India.
